The minimum wage has been increased, an election of representatives for the Employment Platforms Social Relations Authority (EPRA) and the industrial tribunal compensation has been revised. These are some of the amendments to social law that will come into effect in May 2022.
The SMIC has been revalued by 2.65% as of Sunday May 1st 2022. This reflects the increase in the consumer price index since its last measurement in November 2021. The net monthly SMIC in mainland France will thus rise from €1,269 to €1,302.64 for a full-time worker, an increase of €34 per month.
The Employment Platforms Social Relations Authority (ARPE), the public institution in charge of social dialogue between platform companies and their workers, will elect its first representatives on May 9 and 16, 2022. The ARPE was created on April 21, 2021 and aims to establish new rights for platform workers despite their self-employed status through a mechanism similar to that of trade union negotiation.
Finally, on May 11, 2022, the plenary assembly of the Court of Cassation will pronounce its deliberation concerning the scale of compensation in the event of dismissal without real and serious cause of an employee. This scale, currently provided for in Article L. 1235-3 of the Labour Code, imposes both a minimum and a maximum on this compensation depending on the employee's period of service and the size of the company.
This scale, known as the "Macron scale", is particularly controversial in certain courts and the judgment of May 11, 2022 should therefore be the final ruling on the validity of this system.
